Strategic Projects and the Capacity Gap

Some data centre developments could receive a second layer of strategic recognition. Articles 14 and 15 connect project selection with essential public functions, sustainability, grid stability, EU-designed technology, and continuous monitoring of compute supply and demand. 1. Start with the legal status and the core problem

A proposal, not current law

As of July 19, 2026, the Cloud and AI Development Act is a Commission proposal adopted on June 3, 2026. Its legislative procedure remains ongoing, so Articles 14 and 15 are proposed rules rather than enforceable obligations.

What is the capacity gap?

A capacity gap is the shortfall between demand for suitable computing infrastructure and available capacity. It can exist even where data centres are present if capacity is distant, unavailable, unsuitable, or poorly connected.

Think geographically

Picture an EU map with dense compute hubs and underserved regions. The proposal focuses on both total capacity and its distribution, especially where low-latency or resilient services need nearby compute.

2. Separate the two meanings of 'strategic'

Acceleration zones are place-based

An acceleration zone is a Member State-designated area intended to coordinate deployment conditions. The proposal provides for baseline permitting, a single information point, and a twelve-month permitting ceiling after a comprehensive application.

Article 14 is project-based

Under Article 14, the Commission may designate an individual data-centre project after an open call for expressions of interest. The operator must demonstrate that the project meets the proposed selection criteria.

Do not merge the labels

Zone status concerns where a project is developed. Article 14 designation concerns what strategic contribution that particular project makes. One status does not automatically create the other.

3. Use the Article 14 two-out-of-five test

The threshold

A project must fulfil at least two of five Article 14 criteria to be eligible for possible Commission designation through an open call. Eligibility is not the same as automatic designation.

Criteria 1 to 3

The first three criteria concern support for essential public functions, highly sustainable or innovative features, and a positive contribution to grid security, safety, stability, or identified system needs.

Criteria 4 and 5

The final criteria concern integration of EU-designed and/or EU-manufactured technology, or addressing a major monitored compute shortage while significantly supporting the local economy.

Build an evidence table

For each claimed criterion, link a project feature to a measurable outcome and credible evidence. Examples include a grid operator assessment, a public-service contract, engineering specifications, or capacity-demand data.

4. Activity: classify project claims

Match each claim to an Article 14 criterion

A proposed 80 MW data centre makes these claims:

  • It will host a regional health-data platform and university research workloads.
  • It will use on-site battery storage and co-located solar generation. The transmission system operator confirms that its flexibility plan supports local grid needs.
  • It will install servers containing some EU-designed accelerators.
  • It will create construction jobs.

Your task

For each claim, decide whether it is:

  • Strong evidence for one Article 14 criterion;
  • Potential evidence but incomplete; or
  • Not enough by itself.

Then identify the strongest two-criterion case.

Suggested answer

  • Health-data and university workloads: strong for essential public-sector functions, provided the link is direct and operational.
  • Storage, solar, and system-operator confirmation: strong for the grid criterion.
  • EU-designed accelerators: potential evidence for the EU technology criterion, but the application should quantify their integration and supply-chain relevance.
  • Construction jobs alone: not enough. The local-economy criterion also requires addressing a major capacity shortage identified under Article 15.

5. Turn strategic claims into credible evidence

Evidence is required

Applicants must submit necessary and relevant information demonstrating compliance with the criteria they claim. They must also support their predicted project lifetime because proposed designation duration depends on it.

From claim to proof

Use a five-part workflow: choose criteria, show a causal link, quantify the contribution, obtain independent validation where relevant, and document the operating lifetime.

Status can be withdrawn

Under the proposal, the Commission may withdraw a designation if the project no longer meets its criteria or if inaccurate application information affected compliance. The project then loses rights connected to that status.

6. Worked example: NorthRiver Compute Campus

The project profile

NorthRiver combines public-sector workloads, waste-heat reuse, battery-backed flexibility, and a location in an area identified as underserved. It has several possible strategic-value pathways.

Strongest criteria

The project has plausible evidence for public functions, sustainability or innovation, grid contribution, and response to a monitored shortage. It lacks a stated commitment on EU-designed or EU-manufactured technology.

The application logic

NorthRiver should present a criterion-by-criterion evidence file in an open call. Location in an acceleration zone may help deployment, but it is not itself a substitute for Article 14 designation.

7. Mini design challenge: improve a weak proposal

Scenario

A developer proposes a 40 MW facility near a major existing data-centre hub. It has conventional cooling, no public-sector customers, no storage or demand-response plan, and no confirmed integration of EU-designed technology. The developer argues that it will create jobs.

Your task

Choose two changes that would most improve its Article 14 case:

  1. Sign a long-term service arrangement supporting regional emergency management, hospitals, or universities.
  2. Add clean-energy generation, storage, and a flexibility plan assessed by the relevant system operator.
  3. Increase advertising spending in the local area.
  4. Commit to integrating qualifying EU-designed and/or EU-manufactured components, with a verifiable procurement plan.
  5. Claim that demand for AI will probably grow everywhere.

Debrief

Options 1, 2, and 4 map directly to Article 14 criteria. Option 5 would become stronger only if Commission monitoring identifies a major local compute shortage. Job creation may support the local-economy part of criterion 5, but cannot satisfy that criterion without the identified shortage element.
