Pillar Two: Data Centre Acceleration Zones
Faster deployment does not simply mean removing permits. Articles 10 to 13 create a place-based model combining grid planning, connectivity, waste-heat reuse, sustainability, brownfield preferences, single information points, baseline permits, and a proposed twelve-month permitting ceiling. 1. Start with the legal status and the basic model
Proposal, not current law
As of July 19, 2026, COM(2026) 502 final is an ongoing legislative proposal. Articles 10 to 13 are proposed rules, not enforceable EU obligations.
A place-based deployment model
An acceleration zone is a designated area prepared for faster data-centre deployment through coordinated planning, infrastructure information, and permitting.
Not deregulation
The design is prepare-first, permit-faster. It does not erase environmental, construction, or installation-specific requirements.
2. Identify when a Member State would have to designate a zone
The proposed trigger
Where data-centre capacity is being deployed in a Member State, Article 10 would require that Member State to designate at least one acceleration zone.
The proposed timing
The draft deadline is six months after entry into force. Since the proposal was still ongoing on July 19, 2026, that clock had not begun.
Use a four-question test
Check deployment, entry into force, the minimum one-zone requirement, and whether the Article 10 location and infrastructure factors were actually assessed.
3. Activity: Does the designation duty apply?
Scenario check
A Member State has no operating hyperscale facility, but two companies have publicly announced planned data-centre campuses. One developer has submitted an early grid-connection inquiry; neither project has a construction permit. The final Regulation has not yet been adopted.
Your task
Work through these questions:
- Can you say that Article 10 currently imposes a legally binding duty on the Member State?
- If the Regulation later enters into force and data-centre capacity is being deployed, what is the proposed minimum designation requirement?
- Would waiting until every individual project has a final building permit fit the purpose of an acceleration-zone model?
Suggested answer
- No. The instrument remains a proposal as of July 19, 2026.
- The Member State would have to designate at least one acceleration zone within the proposed six-month period after entry into force.
- Probably not. The model is intended to support anticipatory spatial, grid, connectivity, and environmental preparation. However, the final wording and its application would depend on the adopted Regulation.
4. Apply the Article 10 site-selection checklist
Start with physical fit
Define the location, dimensions, and buildable scale. A zone should specify what kind of facility its land and planning context can actually host.
Power and connectivity are co-dependencies
Assess current and future grid capacity, storage and clean generation options, and high-capacity communications connectivity. A data centre needs both.
Treat heat as a resource
Map whether waste heat can be reused by district heating, industry, or nearby buildings. This changes site selection from a single-building decision into a local-system decision.
Prefer reuse and resilience
Article 10 favours brownfield over greenfield development and requires attention to environmental impacts, carbon reduction, and climate resilience.
5. Worked example: Choosing between two candidate sites
Two candidate sites
Northport is an industrial brownfield near a substation, fibre routes, and district heating. Riverside is cheaper greenfield land but has weaker infrastructure and flood risk.
Compare whole systems
Assess land status, grid-upgrade feasibility, network redundancy, waste-heat reuse, and environmental resilience together rather than choosing only by land price.
Defensible outcome
Northport is the stronger proposed zone because it better fits the brownfield, connectivity, heat-reuse, planning, and resilience objectives, subject to further assessments.
6. Connect zone designation to grid planning and sustainability
Plan future demand
The proposed framework links zones to analysis of current and future energy needs and greenhouse-gas impacts, reviewed at least every three years.
Feed evidence into the grid plan
Transmission and distribution network plans would need to take the zone analysis into due account, including potential anticipatory investment.
Sustainability and fair access
Article 11 uses the Energy Efficiency Directive's data-centre KPI framework and prohibits speculative reservation or foreclosure of zone resources.
7. Use the single information point across the project lifecycle
Lifecycle support
On request, an operator would receive assistance from a single information point throughout the project lifecycle for the authorisations needed to deploy a data centre.
Coordinate the moving parts
The point can help with planning, environmental matters, water, wastewater, heat recovery, reporting, public information, and network-connection applications.
Coordination is not substitution
The single information point does not automatically issue every permit. It coordinates procedures and information across the competent authorities.
8. Distinguish the aggregated baseline permit from project permits
Layer 1: zone-level preparation
An aggregated baseline permit would authorise commonly required activities across a designated zone after zone-level planning and environmental work is completed.
Layer 2: project-specific controls
Individual data centres still need permits for activities outside the baseline permit. Installation-specific permits and grid-connection permits are not swept into it.
The proposed 12-month ceiling
The draft caps the permit-granting procedure at 12 months after a comprehensive application is submitted. It is a proposed rule, not current law.
9. Activity: Build a permit pathway
Sort the approvals
A developer proposes a 40 MW facility inside an acceleration zone. The zone already has an aggregated baseline permit. The developer must now address these items:
- A zone-wide environmental assessment already completed before the baseline permit.
- The facility's detailed building design and construction documentation.
- A request to connect the facility to the electricity grid.
- A facility-specific wastewater-discharge arrangement.
- A district-heating interface that uses recovered waste heat.

The lesson is simple: the baseline permit reduces duplication, but it does not make every later project approval disappear.
