Chapter 3 of 12
Set Defensible Boundaries for Production
Students will be able to design a proportionate and reproducible response to a regulator’s information demand.
1. Start with a defensible production proposition
The production proposition
A defensible response is not "send everything." It is a reproducible method for producing responsive, non-privileged material within stated boundaries.
Write the rule first: defined custodians, systems, time period, searches, and validation. For N I S Two, the legal basis will generally be national transposing law and the demand; for the G D P R, authority powers arise directly from Article 58, supplemented where applicable by national procedure and the specific order.
2. Translate the demand into discrete questions
Parse before you collect
Create a request map with one row per demand item:
- Question: What fact or compliance issue is being examined?
- Deliverable: Documents, data export, explanation, access, or named record?
- Subject: Which entity, product, service, system, or incident?
- Period: Exact start and end dates.
- Authority language: Mandatory wording, stated purpose, deadline, format, and legal basis.
Thought exercise: A data protection authority asks for "all security assessments relating to the customer portal." Does "relating to" mean only the portal application, or also identity services and cloud configuration? Record both interpretations, then seek written confirmation or adopt the narrower operational definition that still answers the stated question.
3. Clarify scope early and in writing
Clarify the object
Ask what the authority actually needs: final reports, remediation evidence, underlying logs, or a staged combination. Put the agreed interpretation in writing.
Offer an index or core tranche first. Clarification should improve relevance and timeliness, not become a disguised refusal.
For product surveillance, proportionality is explicit. The C R A generally applies from 11 December 2027; Article 14 has applied since 11 September 2026, while Chapter IV, concerning notification of conformity-assessment bodies, has applied since 11 June 2026. Chapter V contains market-surveillance and enforcement provisions and generally applies from 11 December 2027.
4. Select custodians by knowledge, not job title
Custodian matrix
Select people by their connection to the requested facts: creator, approver, operator, recipient, or decision-maker. Record repositories and dates beside each name.
Example
For MFA evidence, begin with identity engineering, security operations, change control, and the exception approver—not every engineer or every executive.
5. Set search boundaries that match the question
Five boundaries
Define systems, dates, terms, population, and exclusions. Each boundary must connect to the authority's question and be recorded before broad collection.
Use technical synonyms and identifiers: a C V E identifier, hostname, ticket prefix, "emergency change," and vendor name may locate different responsive evidence.
6. Validate the production, not just the search
Coverage test
Compare results against a known anchor. A timeline meeting, change ticket, or report that produced no record is a gap to investigate, not an inconvenience.
Integrity test
Check readability, material metadata, attachments, duplicate handling, and consistency across custodians. Keep a request-to-production log.
7. Deliver with a transparent boundary statement
Production letter
State what was produced, in what format, and under which boundaries. Identify any staging, material gaps, and the method used to find records.
Reserve rights precisely: confidentiality, trade secrets, privilege, agreed scope, and supplementation. A blanket reservation can undermine a cooperative response.
Apply the boundary method
Choose the most defensible first response
A regulator seeks evidence that an exposed gateway was patched during a defined two-month period. The demand does not identify systems or documents.
What is the best first production design?
- Confirm the gateway and requested evidence categories, then search defined technical and change-management sources using the hostname, C V E identifier, ticket references, and the stated period.
- Collect every security employee mailbox and all vulnerability records for the previous three years to avoid missing anything.
- Produce only the final patch report because underlying tickets and logs are always outside a regulator's request.
Show Answer
Answer: A) Confirm the gateway and requested evidence categories, then search defined technical and change-management sources using the hostname, C V E identifier, ticket references, and the stated period.
The first option links a clarified request to documented custodians, systems, dates, and technical search terms. It is proportionate, reproducible, and can be expanded if the authority confirms a broader need.
Key Terms
- Search boundaries
- The defined systems, date range, terms, population, and exclusions used to collect potentially responsive material.
- Custodian selection
- Choosing individuals and shared repositories because of their connection to responsive facts or records.
- Production validation
- Testing whether collection was complete enough for the request and whether produced materials are responsive, readable, and traceable.
- Reservation of rights
- A precise statement preserving legal positions, such as confidentiality, privilege, or scope objections, without withholding responsive facts.
- Request interpretation
- A documented reading of what the authority is asking, why it is asking, and the entities, records, dates, and formats covered.
