Chapter 2 of 12

Control the First Regulatory Contact

Students will be able to classify an initial regulatory contact and select the corresponding internal response protocol.

1. Treat Every Contact as a Classification Problem

Classify before responding

Classify the contact as a voluntary inquiry, compulsory demand, on-site inspection, or urgent measure by its legal effect and requested action—not its tone or format.

An informal email may invoke a compulsory power. An urgent request for information is not necessarily an urgent measure. Check the instrument and applicable national procedure.

2. Run the 10-Minute Intake

Build a contact card

Record the sender, addressee, cited power, operative verbs, deadline, service method, stated consequences, and requested action. Then assign a provisional label and owner.

Acknowledgment is not a substantive response. Use neutral language while Legal verifies the contact and assigns response authority.

3. Protocol for a Voluntary Inquiry

Voluntary inquiry protocol

Verify the sender, centralize communications, define the agenda, approve the facts and document the discussion.

A coordinator may acknowledge and schedule. Approved experts provide facts; Legal controls submissions and commitments.

4. Route a Compulsory Demand Immediately

Compulsory demand: route and stabilize

Preserve the notice and service evidence, record the power and deadline, escalate to Legal, and prevent unauthorized facts, records, or commitments.

A demand may remain compulsory even if it does not state every checklist element. Its effect depends on the applicable power and procedure.

5. Switch to Inspection Mode for an On-Site Visit

At reception: pause and mobilize

Ask officials to wait in the designated area, record credentials and authority, notify the response team, and begin a log. Do not consent, obstruct, or provide access without authority.

Legal addresses service and legal access; the site lead manages escorts and safety; Security enables only authorized technical access.

6. Treat an Urgent Measure as an Operational Decision

Urgent measure: verify, escalate, execute

Verify the operative order and effective time, escalate to Legal and operational authority, execute the authorized control, and document completion.

An urgent request for a quick explanation is not the same as an order requiring immediate operational change.

7. Establish Response Authority

Response authority prevents accidental commitments

Define who may acknowledge, provide facts, release records, permit access, accept service, execute controls, and commit the company.

Close intake with a written classification note naming the label, basis, deadline, owners, safeguards, and next decision point.

Apply the Classifier

Choose the first response protocol

A market-surveillance authority arrives without appointment, presents credentials and a written notice, and asks to inspect devices and obtain a software build. What is the best first classification and action?

What should counsel do first?

  1. Classify it as an on-site inspection; verify authority and scope, activate the inspection team, assign escorts, and begin a contemporaneous log.
  2. Treat it as a voluntary inquiry because the authority did not send an email in advance.
  3. Allow engineers to provide direct access immediately, then ask Legal to summarize the visit afterward.
Show Answer

Answer: A) Classify it as an on-site inspection; verify authority and scope, activate the inspection team, assign escorts, and begin a contemporaneous log.

Physical attendance with a written notice and requests to inspect devices or obtain software calls for the on-site inspection protocol. Verification, designated response authority, controlled access, escorts, and logging support cooperation without unauthorized consent or disclosure.

Key Terms

Urgent measure
A direction requiring immediate or time-critical operational action, such as stopping an activity or complying with a restriction.
Compulsory demand
A notice, order, or statutory request issued under a power that can require compliance. Its effect depends on the applicable power and procedure, even if every checklist element is not expressly stated.
Voluntary inquiry
A request for information, clarification, or discussion that does not itself invoke a power requiring compliance.
On-site inspection
An investigatory contact involving requested entry, observation, interviews, records, systems, samples, or physical evidence at a location.
Response authority
Pre-assigned internal decision rights defining who may acknowledge, provide facts, release records, permit access, accept service, execute controls, or commit the company.
